This Stock Images & Customer Content Policy is part of the Terms of Service. It explains who is responsible for what appears on websites, forms and messages built with DailyCRM, how the stock image search works, which rules apply to stock images, and how to report content that infringes someone’s rights. Capitalized terms have the meaning given in the Terms.

1. You are responsible for your content

You — the business that owns the account — are solely responsible for every image, photo, video, logo, text, price, offer, review, testimonial and claim on your Customer Sites and in your communications, whether you uploaded it, your team took it, you wrote it, an AI Feature generated it, it came from a template, or you selected it from the stock image search in DailyCRM.

DailyCRM provides tools, not content. We do not review, approve or verify what you publish, and we are not the publisher of your Customer Sites. Before publishing anything, make sure you have the rights to use it, that it is accurate, and that it complies with the law and with this policy.

2. Stock image search (Pixabay)

  • The site editor can search for free stock images provided by Pixabay through its API. The images are uploaded to Pixabay by its contributors and licensed by Pixabay under the Pixabay Content License — not by DailyCRM.
  • The search is offered only as a convenience, without any warranty. DailyCRM does not own the images and does not check who created them, whether the uploader had the right to share them, whether people shown have signed model releases, whether property, artworks or buildings shown have property releases, whether the image contains trademarks, logos or brands, or whether descriptions and tags are accurate.
  • Pixabay may remove an image or change its licence or API at any time. If an image disappears from Pixabay or we receive a complaint about it, we may remove it from your Customer Site.
  • When you select an image, DailyCRM may store a copy of it in our storage so that your Customer Site can display it. Selecting it makes it your Customer Content: you decide whether and how to use it and you are responsible for that use.
  • Search terms you enter are sent to Pixabay to return results. Do not include personal information in searches.
  • Before you use stock images, the editor may ask you to confirm that you accept this policy; we may keep a record of that confirmation with your account.

3. Pixabay Content License — summary

Below is a short summary for convenience. Only the full Pixabay Content License (and Pixabay’s Terms of Service) is legally binding, and you must read and comply with it.

Generally allowed

  • Using images for free, including for commercial purposes, without asking for permission.
  • Using images without attribution (crediting the author is appreciated but not required).
  • Modifying and adapting images.

Not allowed (Prohibited Uses)

  • Selling or distributing images on a standalone basis — for example, selling unaltered copies, offering them as prints, wallpapers or downloads, or including them in another stock collection.
  • Using images that show recognizable trademarks, logos or brands for commercial purposes in relation to goods and services, including printing them on merchandise or products for sale.
  • Using images in an immoral or illegal way, especially images featuring recognizable people — for example, in a way that is offensive, defamatory, or suggests that a person has a health condition, uses a product, endorses your business or holds views they may not hold.
  • Using images in a misleading or deceptive way — for example, presenting stock photos as pictures of your own team, your own vehicles or premises, your clients, or as “before and after” results of your work.
  • Using images as part of a trademark, design mark, trade name, business name or service mark — in particular, never use a stock image in or as your logo or brand mark.

4. Truthful use of images and claims

  • “Before and after” pictures and portfolio photos must show work your business actually did.
  • Photos of “our team”, vehicles, equipment or premises must be your own, or clearly presented as illustrations.
  • Reviews and testimonials must be genuine, from real clients, not edited to change their meaning, and must disclose any incentive where the law requires (including the US FTC rule on consumer reviews and testimonials and the Competition Act in Canada).
  • Statements about licences, insurance, certifications, guarantees, prices and results must be true and current.

5. Your own uploads and people in photos

  • Upload only photos and files you created or have a licence to use. Photos found on the internet (including on search engines, social media or competitors’ sites) are usually protected by copyright.
  • Get permission before publishing photos in which people can be identified (clients, employees, members of the public), and avoid showing clients’ addresses, house numbers, licence plates or personal belongings unless they agreed.
  • DailyCRM removes location (GPS) metadata from many uploaded images, but you remain responsible for what the image itself shows.

6. AI-generated texts

Texts generated with AI Features are drafts. Check every fact, claim, price and promise before publishing; remove anything that is not true for your business. Published AI text is your Customer Content.

7. What we may do

We are not obliged to monitor content, but we may, at our discretion and without liability, remove, replace with a placeholder, unpublish or disable access to any content, suspend a Customer Site or an account, if we believe the content violates this policy, the Terms, the Acceptable Use Policy, a third-party licence or the law, or if we receive a complaint or notice about it.

8. Reporting infringing content (notice and takedown)

If you believe content on a website or service hosted by DailyCRM infringes your copyright or other rights, send a written notice to our designated agent:

Copyright / content agent: [COPYRIGHT AGENT NAME], [OPERATOR LEGAL NAME], [OPERATOR ADDRESS], email [COPYRIGHT AGENT EMAIL].

To be effective (including under the US Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(3)), the notice must include:

  1. your physical or electronic signature (or that of the person authorized to act for the rights owner);
  2. identification of the copyrighted work or other right you claim is infringed;
  3. identification of the material you claim is infringing and its exact location (URL of the page and, if possible, of the image);
  4. your name, address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorized by the rights owner, its agent or the law; and
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the rights owner or authorized to act on its behalf.

When we receive a valid notice, we may remove or disable access to the material, inform the account owner and forward a copy of the notice (which may include your contact details). Notices under Canada’s Copyright Act notice-and-notice regime are also accepted at the same address and will be forwarded as the law requires. Knowingly misrepresenting that material is infringing may make you liable for damages (17 U.S.C. § 512(f)).

9. Counter-notice

If your content was removed and you believe that was a mistake or that you have the right to use it, the account owner may send a counter-notice to the same agent containing:

  1. your physical or electronic signature;
  2. identification of the material removed and where it appeared before removal;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the courts for your address (or, if outside the United States, any judicial district in which DailyCRM may be found) and will accept service of process from the person who sent the original notice.

We may forward the counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days after receiving the counter-notice, at our discretion.

10. Repeat infringers

We will, in appropriate circumstances and at our discretion, suspend or terminate the accounts of customers who repeatedly infringe the rights of others or are the subject of repeated valid notices.

11. Other complaints

Complaints about trademarks, privacy, defamation or other unlawful content can be sent to [ABUSE EMAIL] with the URL, a description and your contact details. We may forward them to the account owner, who is responsible for the content and for responding.

12. Indemnity

As set out in the Terms, you will defend, indemnify and hold harmless DailyCRM from any claims, losses and costs (including reasonable legal fees) arising from images, texts and other content on your Customer Sites and in your communications, including stock images you selected and any breach of the Pixabay Content License or this policy.

This document is written in English. Any translation is provided for convenience only; if there is a conflict, the English version governs to the extent permitted by law.
